These terms apply to everyone who uses Life Loyalty: members who carry a loyalty stamp card, the businesses that run a programme, and anyone using this website. By using Life Loyalty you agree to them, so please read them. They sit alongside our privacy policy, which explains what happens to your data.
Life Loyalty is Life Loyalty Limited, a company registered in England and Wales. Our company details are on the legal notice. In these terms, “we” and “us” mean Life Loyalty Limited, and “you” means the person using the service.
The short version
- Life Loyalty is a platform. Each loyalty programme is run by its own business, which decides the rewards and is responsible for honouring them.
- Stamps and rewards have no cash value, cannot be sold or transferred, and can be changed or ended by the business that offers them.
- The service is provided as it is and as available. We work to keep it running, but we cannot promise it will never be interrupted.
- We can change these terms and the service. If a change matters, we tell you at least 10 days before it applies, and you can stop using the service at any time.
Who does what
We run the platform. We provide the technology that holds your loyalty stamp cards, records your stamps, puts your pass in Apple Wallet or Google Wallet and lets a business’s staff scan it. A loyalty stamp card records stamps and rewards only. It is not a payment, debit, credit or gift card, holds no money, and cannot be used to pay for anything.
Each business runs its own programme. The business decides what earns a stamp, what the rewards are, how long they last and any rules of its own. Those rules are the programme’s terms, shown to you when you join, and they apply alongside these. The business, not us, is responsible for honouring the stamps and rewards it offers, and for anything it sells you. If you have a question about a reward or a purchase, ask the business first.
If you are a member
Joining
You join a programme by signing up with your mobile number. You must be at least 16 years old. You are responsible for keeping your phone and your pass to yourself: anyone holding your pass can have it scanned. If you think someone else is using your account, contact us.
The service is free for members. Your mobile network may charge for text messages or data in the usual way.
Stamps and rewards
Stamps and rewards are a goodwill benefit offered by the business. They:
- have no cash value and cannot be exchanged for money;
- cannot be sold, transferred or combined with another member’s;
- belong to the programme that issued them and can only be used there;
- may expire, if the programme’s terms say so.
A business may change, pause or end its programme, including its rewards, at any time. If it ends its programme, stamps and rewards that have not been used may be lost. Whether and how unused rewards are honoured is the business’s decision.
Stamps are issued by the business’s staff at their discretion. If a stamp was issued by mistake, or through misuse, the business may remove it.
Leaving and deleting your data
At any time, from your own account, you can:
- leave a programme, which ends your membership and deletes the details that programme holds about you; or
- delete your data, from one programme or from every programme you belong to.
Either way, the stamps and unused rewards you had with that programme are lost and cannot be restored, even if you join it again later. If you delete your data from every programme, your Life Loyalty account is closed. What is kept afterwards, and for how long, is set out in the privacy policy.
If you run a programme
Your subscription
What your business receives, and what it costs, is set by the subscription you signed up to. You agree to pay any fees due under it, as and when agreed.
We are always developing Life Loyalty, so features may be added, changed or removed over time. If a change significantly reduces what your subscription includes, or its price goes up, we will tell you at least 10 days before it applies, and you can cancel before then. Unless we have agreed otherwise with you in writing, the service is provided without any guaranteed level of availability or support.
Your programme
You are responsible for your programme: the rewards you offer, the rules you set, the terms you show to members, and honouring what you promise. You are responsible for the people you give access to, and for what they do with it.
You are responsible for using your members’ data lawfully and in line with the choices they make, as set out in the privacy policy. You must not upload anything you do not have the right to use, such as logos or images.
Using the service properly
Everyone using Life Loyalty agrees not to:
- use it for anything unlawful, fraudulent or misleading;
- obtain stamps or rewards dishonestly, or help anyone else to;
- interfere with, overload or try to gain unauthorised access to the service;
- copy, resell or build a competing service from any part of it.
We may suspend or close an account, or remove stamps and rewards, where we reasonably believe these terms have been broken or the service is being misused. Where we can, we will tell you why.
Availability
We work to keep Life Loyalty running and your data safe, but the service is provided “as is” and “as available”. We do not promise that it will always be available, uninterrupted or free of errors. We may suspend it for maintenance, security or reasons outside our control.
Apple Wallet and Google Wallet are services of Apple and Google. We do not control them, and your use of them is subject to their own terms. If a wallet is unavailable, your loyalty stamp cards are still shown in your Life Loyalty account.
Changes
We may change these terms and the service from time to time, for example to add features, to reflect how the service works or to meet legal requirements.
If a change is significant, we will tell you at least 10 days before it applies, by email or in the service. If you do not agree, you can stop using the service, leave any programme or delete your data before the change applies. Continuing to use the service after that means you accept it.
We may make a change straight away, without notice, where it is minor, does not disadvantage you, or is needed for security or to meet the law.
The date at the top of this page shows when these terms last changed.
Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you also have legal rights these terms do not affect.
Apart from that:
- We are not responsible for the rewards, goods or services a business offers, or for anything a business does or does not do.
- We are not responsible for losses that were not a foreseeable result of our breaking these terms, for loss of stamps or rewards through a programme ending, or for problems caused by Apple, Google, your mobile network or your device.
- If you use Life Loyalty for a business, we are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect loss.
- Our total liability to you for anything arising from the service is limited to £100.
General
If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms are between you and us, and nobody else has rights under them.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
